A. The hassle, expense, delay, and
frustration of using an out-of-State will in New Hampshire may persuade one to
use a New Hampshire attorney to create a new will. Every State is different in how they
provide wills to beneficiaries or their attorneys. Some States will not even
provide a copy to the beneficiaries or their legal representative. Other States
also have a custodial entity that retains the executed wills of clients.
Getting them has proven to be an exhausting process, causing unnecessary delay
in administering a New Hampshire estate.
If your will was executed in another State
or in a foreign country you will also need to have an attorney from the other
State or foreign country complete the New Hampshire probate form stating the
will was properly executed in their jurisdiction. This will cause further delay
and expense in an already emotional time.
Attorney Richard E. Clark advises his New
Hampshire clients to complete a valid, enforceable estate plan within the
jurisdiction of New Hampshire.
