Q. Did Stryker recall their Rejuvenate and ABG II modular neck-hip stems?

A. In June 2012, Stryker issued a voluntary recall of its Rejuvenate and ABG II modular neck-hip stems due to component corrosion threat at the hip junction. This has resulted in adverse local tissue reactions, unusual discharge in the hip junction area, pain and swelling.

Experienced Stryker Hip recall attorneys within the Law Office of Richard E. Clark will recommend clients seek a surgeon to immediately perform a clinical examination. Blood test may also reveal highly elevated traces of Cobalt, called metallosis or metal poisoning, indicating a problem with the Stryker hip. Typically the surgeon will contact the Stryker hip recall patient by sending the recipient a letter.

Replacing the defective Stryker hip is also known as a Revision. The Revision will require a substantial incision to remove the hardware and install new components. It is painful. To remove the Stryker hip parts a hammer is typically used. Your femur will be reamed out. Patients may suffer bone fractures during the removal process. Infections can occur and other collateral injuries are possible. Even after the surgery is completed, patients will be ordered ongoing physical therapy that could last up to six months or more.

Q. If I’m a New Hampshire resident and I created my will in another State, should a New Hampshire attorney redo my will?

A. Yes.  The additional cost alone will usually make it worth your while to create a New Hampshire will if you reside here. If you do not create a New Hampshire will you will incur the expense of having your attorney deal with having the out of State attorney review the will and complete the Foreign Affidavit form. The other attorney will charge you too. A quote our office just received for having the other attorney do this was $600.00.

Should a New Hampshire resident that completed their existing will in another State, create a New Hampshire will?

A.  The hassle, expense, delay, and frustration of using an out-of-State will in New Hampshire may persuade one to use a New Hampshire attorney to create a new will. Every State is different in how they provide wills to beneficiaries or their attorneys. Some States will not even provide a copy to the beneficiaries or their legal representative. Other States also have a custodial entity that retains the executed wills of clients. Getting them has proven to be an exhausting process, causing unnecessary delay in administering a New Hampshire estate.
If your will was executed in another State or in a foreign country you will also need to have an attorney from the other State or foreign country complete the New Hampshire probate form stating the will was properly executed in their jurisdiction. This will cause further delay and expense in an already emotional time.

Q. When can I file to increase or decrease my existing Child Support court order in NH?

A. At any time a person paying or receiving child support may ask the court to change the support order based on a substantial change of circumstances.  If three years have passed since the last child support order was issued, either party may ask the court to change the order without needing to show a substantial change in circumstances.

Q. If I die without a will in NH, who gets my property?

A.  If you die without a will in NH, the State of New Hampshire will decide who gets your property. It will follow the statute. Every case is different. You should consult a NH estate lawyer with experience in wills, or lack thereof. Why let the State decide who gets your property. For a minor cost, you can determine who gets what. This will also expedite the probate process and mitigate family strife.
