Q. When can I file to increase or decrease my existing Child Support court order in NH?

A. At any time a person paying or receiving child support may ask the court to change the support order based on a substantial change of circumstances.  If three years have passed since the last child support order was issued, either party may ask the court to change the order without needing to show a substantial change in circumstances.

Q. If I die without a will in NH, who gets my property?

A.  If you die without a will in NH, the State of New Hampshire will decide who gets your property. It will follow the statute. Every case is different. You should consult a NH estate lawyer with experience in wills, or lack thereof. Why let the State decide who gets your property. For a minor cost, you can determine who gets what. This will also expedite the probate process and mitigate family strife.

Q. What is the Notice of First Appearance from the Court in a NH divorce?

A.   Attendance at the first session is ordered by the Court, you are required to appear. A Judge or Marital Master will conduct the session. The purpose is to familiarize you with the court process, to get you to feel a little more comfortable with the setting, explain options to resolve your divorce, and to schedule the next court event.

The sessions vary in duration but plan on spending up to two hours. Courts do not have childcare. You should register for a Child Impact Seminar prior to the hearing date.
