Can I annul my criminal records including arrest, conviction and sentencing in NH?



A. Yes. However, there are many exceptions, time limitations and requirements to do this effectively.  First you must complete all terms and conditions of the sentence and thereafter been convicted of no other crimes within the statute.  Some misdemeanors in New Hampshire require a 3-year wait period, some felony crimes require a 5 or 10-year wait period.

Certain crimes cannot be expunged. The benefit of an order by the Court of annulment is the person whose record is annulled shall be treated I all respects as if he or she had never been arrested, convicted or sentenced, except that, upon convictions of any crime committed after the order of annulment has been entered, the prior conviction may be considered by the court in determining the sentence to be imposed, and may be counted toward habitual offender status under RSA 259:39.
